Definitions
The following definitions apply throughout this Agreement:
- Agreement refers to the agreement between HostGrower Limited and the Customer for HostGrower Limited to provide services to the Customer.
- Bandwidth refers to the data transmission rate in bits per second using HostGrower Limited equipment.
- Confidential Information means information that either party has identified as confidential or proprietary, or whose nature is clearly confidential or proprietary.
- Customer refers to you, an individual or entity who has agreed to these Terms of Service.
- Fees refers to the fees for the services, as displayed on hostgrower.com.
- Intellectual Property Rights means any and all patents, trademarks, service marks, copyrights, know-how, design rights, or other intellectual or similar rights, whether or not registrable in any country, as well as all or any goodwill relating to the same.
- Services refers to hosting.
- HostGrower Limited refers to HostGrower Limited, a company registered in England and Wales with company number 14636097.
- You, Your and their grammatical variants refer to you, any other entity that owns or has a beneficial interest in you, or any other entity in which you own or have a beneficial interest.
1. Server Use
HostGrower Limited does not permit the storage of any of the following content on its servers:
- Illegal material, including copyrighted works, commercial audio, video, or music files, and any material in violation of any UK legislation.
- Pornography, erotic images, and other lewd or obscene content. The determination of "adult material" is at HostGrower Limited's sole discretion.
- Use of pirated software, ROMs, emulators, hacking tools, password cracking, IP spoofing, or encryption for any of the above.
- Websites offering "links to" or "how-to" information about such materials.
2. Unrestricted Bandwidth Policy
HostGrower Limited provides unrestricted use by maintaining very high bandwidth-to-customer ratios. If a customer is found abusing server resources and affecting other customers, HostGrower Limited reserves the right to implement the High Resource User Policy.
3. High Resource User Policy
Resources refer to bandwidth, processor usage, or disc space. If a website monopolises available resources, HostGrower Limited may suspend the server to prevent misuse. This policy is enforced only in extreme cases.
4. Fees, Billing & Cancellation
All matters relating to fees, payment terms, billing cycles, cancellations, refunds, and our money-back guarantee are governed by our dedicated Refund and Cancellation Policy, which forms part of this Agreement and should be read in conjunction with these Terms.
5. Value Added Tax (VAT)
All prices displayed on our website exclude VAT at 20%, in accordance with UK regulations. VAT will be applied automatically at checkout if applicable.

Customers outside the UK may be eligible for VAT exemption or reclaim, subject to the provision of supporting documentation.
6. Disclaimers & Warranties
- HostGrower Limited does not back up your data. Loss of data caused by corruption, failures, or customer error is not covered.
- All services are provided "as is" without warranties of any kind.
- HostGrower Limited is not liable for third-party services or indirect losses.
7. Force Majeure
Neither party shall be liable for breaches arising due to acts of God, government actions, war, riots, network failures, or third-party service interruptions.
8. Governing Law & Disputes
This Agreement is governed by the laws of England and Wales and is subject to the exclusive jurisdiction of the courts of England and Wales.
9. Email Usage Policy
You may not use HostGrower Limited email services to send spam, fraudulent, or offensive messages. SMTP traffic may be restricted if bulk unsolicited emails are detected.
10. Reporting Abuse & Misuse
To report abuse, please include the time, date, and relevant logs to assist with investigations. HostGrower Limited will cooperate fully with law enforcement authorities. Abuse may be reported to abuse@hostgrower.com.
11. Domain Name Registrations
- By registering a .uk domain, you agree to Nominet's Terms & Conditions.
- By registering other domains, you agree to OpenSRS policies and ICANN regulations.
- Domains must be registered through or fully managed by HostGrower Limited in order to use its DNS services.
12. Free Domain for Lifetime Offer
This offer is available exclusively for annual WordPress Hosting Ultra packages. It covers .com, .net, .info, .org, and .uk domains. Premium domains are excluded from this offer.
13. Disclaimer of Liability
- HostGrower Limited does not guarantee the accuracy, completeness, or fitness for a particular purpose of its services.
- HostGrower Limited is not responsible for third-party websites linked from its pages.
- HostGrower Limited will not be liable for indirect or consequential losses of any kind.
14. Amendments & Notices
This Agreement may not be modified unless signed by both parties. Notices are considered delivered immediately when sent via email, or within 24 hours when sent by overnight mail.
15. Entire Agreement
This Agreement, together with our Privacy Policy, Acceptable Use Policy, Refund and Cancellation Policy, and Data Processing Agreement, represents the entire understanding between you and HostGrower Limited. Any modifications or representations made outside of this Agreement are not legally binding.
